Terms of Service

Welcome to AIVeed.io. These Terms of Service govern your use of our AI-powered video generation platform. Please read these terms carefully before using our Service.

1. Acceptance of Terms

You accept these Terms by: (i) clicking to accept or agree where available; (ii) creating an account; or (iii) using the Service. If you are using the Service on behalf of an entity, you represent that you are authorized to bind that entity.

We may update these Terms at any time; material changes will be notified via email or in-Service notice at least 30 days in advance (or as required by law). Continued use after changes constitutes acceptance.

2. Description of Service

AIVeed.io is an AI-powered platform that generates videos from text prompts and/or user-uploaded images, featuring AI presenters. The Service includes:

• Text-to-video and image-to-video generation using AI models

• Video hosting, streaming, and editing tools

• User account management and credit-based billing

• Video library, sharing, and management features

• AI transparency tools, such as watermarks and audit logs for generated content (where implemented)

The Service may evolve, and we reserve the right to modify features without notice. AI outputs may contain inaccuracies, biases, or hallucinations; you are solely responsible for reviewing and using generated content.

3. User Accounts

Account Creation

To use the Service, you must create an account with accurate, complete information. You agree to update your information as needed.

Account Security

You are responsible for safeguarding your credentials and all activities under your account. Notify us immediately at support@aiveed.io of any unauthorized access.

Age Requirements and COPPA/GDPR-K Compliance

You must be at least 16 years old to use the Service (or the age of digital consent in your jurisdiction, if higher). If you are under 16 but at least 13, you may use the Service only with verifiable parental consent, which we may request at any time. We do not knowingly collect personal information from children under 13. If we discover such collection, we will delete the data and terminate the account. Parents/guardians can contact us at privacy@aiveed.io to review, delete, or refuse further collection of their child's data.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with these Terms. Prohibited uses include, but are not limited to:

• Generating content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or discriminatory

• Creating or distributing deepfakes or synthetic media depicting real individuals without their explicit, verifiable consent, especially if intended to deceive, harm, or infringe rights (per U.S. DEEPFAKES Act and EU AI Act prohibited practices)

• Producing content that manipulates elections, spreads disinformation, or influences public policy through deception

• Infringing intellectual property rights, including using copyrighted material in prompts or uploads without authorization

• Generating biometric data or AI systems for remote identification in public spaces (prohibited under EU AI Act)

• Engaging in social scoring, emotion recognition in workplaces/education, or other high-risk AI uses without compliance documentation

• Impersonating others or misrepresenting affiliations

• Attempting to reverse-engineer, hack, or gain unauthorized access to our systems

• Using the Service for automated decision-making (ADM) affecting individuals' rights without human oversight, as required by GDPR and CCPA

• Exporting the Service or generated content to embargoed countries or in violation of U.S. Export Administration Regulations (EAR) or International Traffic in Arms Regulations (ITAR)

• Any use violating anti-deepfake laws, such as failing to disclose AI-generated content when shared publicly

User Content Control and Platform Neutrality

All images uploaded, prompts submitted, and videos generated using the Service are created entirely at the sole direction, control, and discretion of the user. AIVeed.io acts solely as a neutral third-party platform that provides AI tools for users to generate their own content. We do not create, curate, edit, or endorse any user-generated content. You are exclusively responsible for all content you upload, generate, or share. We assume no liability for obscene, offensive, unlawful, or otherwise objectionable content created by users, and we expressly disclaim any responsibility or control over such content under Section 230 of the U.S. Communications Decency Act and equivalent safe harbor provisions worldwide.

Deepfake and AI Disclosure Requirements

You are solely responsible for disclosing that any video generated with the Service is AI-created whenever such disclosure is required by law or whenever the video could reasonably deceive viewers. Examples include (but are not limited to): depicting real individuals in false scenarios, political or election-related content, and commercial advertising that mimics real people. We do not currently add watermarks, metadata, or any technical markers to generated videos. However, we reserve the right to implement visible watermarks, invisible metadata (e.g., C2PA), or other provenance signals in the future without prior notice. You agree not to remove, obscure, or tamper with any such markers if added. We actively monitor public shares of generated content and may issue warnings, suspend, or terminate accounts for failure to disclose AI origin. Failure to make accurate, timely disclosures may result in: immediate account termination, loss of any ownership or license rights in the video, and full indemnification liability under Section 11. You agree to defend and hold us harmless from any claim arising from your failure to disclose AI origin.

Blacklist and Account Termination at Our Discretion

We reserve the absolute right, in our sole and unfettered discretion, to blacklist, suspend, or permanently terminate any user account at any time, with or without cause, and without prior notice or liability. This includes, but is not limited to, suspected violations of these Terms, abusive behavior, excessive resource usage, or any conduct we deem detrimental to the Service, other users, or our business. No refunds will be issued for terminated accounts.

Content Moderation and Safety Systems

To protect users and comply with legal obligations, we employ automated content moderation systems that analyze all user-submitted content (text prompts, uploaded images, and video requests) BEFORE processing. These systems use: (i) keyword filtering to detect prohibited content categories (CSAM, explicit material, violence, hate speech); (ii) machine learning models (including AWS Rekognition) to analyze uploaded images for nudity, minors, violence, and other policy violations; (iii) risk scoring algorithms that assign moderation scores (0-200 scale); and (iv) third-party AI safety layers (Veo3/Google) that provide secondary screening. By using the Service, you expressly consent to automated scanning, analysis, and categorization of your content. Content flagged as violating policies will be blocked IMMEDIATELY, and you will NOT receive a refund of credits consumed.

Three-Strike Violation System

We track content policy violations per user account. If your content is blocked for policy violations THREE (3) times, your account will be automatically and permanently banned without notice. Violation counts are tracked across: CSAM attempts (instant ban regardless of count), sexual/explicit content, violence or harm depictions, hate speech or harassment, and other policy violations. Credits consumed by content that is blocked due to policy violations are NON-REFUNDABLE. This policy applies regardless of whether the violation was intentional. By submitting content, you represent that you have reviewed it for compliance.

CSAM Zero-Tolerance and Mandatory Reporting

We have ZERO TOLERANCE for child sexual abuse material (CSAM). Any attempt to generate, upload, or share CSAM will result in: (i) immediate permanent account ban; (ii) forfeiture of all credits and payments (no refunds); (iii) mandatory reporting to the National Center for Missing & Exploited Children (NCMEC) as required by 18 USC § 2258A; (iv) preservation of all account data, IP addresses, and content for law enforcement; and (v) cooperation with criminal investigations, including voluntary disclosure without warrant. You acknowledge that CSAM violations are reported to law enforcement regardless of privacy settings, and you waive any privacy claims related to such reporting.

Law Enforcement Cooperation

We cooperate fully with law enforcement investigations. We may voluntarily disclose user data, content, and account information to law enforcement without notice or warrant when we believe in good faith that disclosure is necessary to: (i) prevent imminent physical harm; (ii) investigate CSAM or child exploitation; (iii) respond to valid legal process (subpoenas, court orders, warrants); or (iv) comply with mandatory reporting obligations. We preserve flagged content and user data for law enforcement purposes for up to 90 days after account termination or as required by law.

Immunity and Indemnification for Moderation

You agree that we are NOT LIABLE for: (i) false positives (legitimate content mistakenly blocked); (ii) false negatives (policy violations that slip through screening); (iii) delays in moderation or reporting; or (iv) any decisions made by automated or human moderators in good faith. You indemnify us against any claims arising from: our content moderation decisions, our NCMEC or law enforcement reports, our cooperation with investigations, or our automated screening systems' outcomes, including biases or errors.

5. Credits, Payments, and Subscriptions

Credit System

Video generation consumes credits (e.g., 120 credits per video, up to 5 segments). Credits are non-transferable, non-refundable (except as required by law, such as EU/UK cooling-off periods), and do not expire while your account is active.

Purchases and Refunds

Payments are processed securely via third-party providers. You authorize recurring charges for subscriptions if applicable. Refunds are issued only for technical errors or as mandated by law (e.g., 14-day withdrawal right under EU Consumer Rights Directive). Prices may change with notice; changes do not affect pre-purchased credits.

Free and Promotional Credits

New users receive 200 free credits upon account verification. Promotional offers may have additional terms.

CCPA/CPRA Compliance for Sales of Personal Information

We do not "sell" personal information as defined by CCPA. If we do in the future, California residents may opt out via privacy@aiveed.io.

Credit Forfeiture for Violations

If your content is blocked by our moderation systems for violating the Acceptable Use Policy, you forfeit all credits consumed by that request. This includes: (i) pre-screening blocks (before video generation starts); (ii) mid-generation blocks (by third-party AI safety layers); and (iii) post-generation takedowns (after review or reports). Even if your content is partially processed before being blocked (e.g., 2 out of 5 video segments completed), NO credits are refunded. You are responsible for ensuring compliance BEFORE submission. Violation penalties: First violation results in warning and credit forfeiture; second violation results in final warning, credit forfeiture, and 48-hour account suspension; third violation results in permanent ban and forfeiture of all remaining credits (no refund). Any CSAM attempt results in immediate permanent ban and forfeiture of ALL credits and payments (past and future), with no exceptions.

6. Content Ownership and Licenses

Your Content

You own your input prompts and uploaded images but grant us a worldwide, non-exclusive, royalty-free license to use, store, and process them solely to provide and improve the Service.

Generated Content

You own generated videos, subject to our underlying rights in AI models and technology. However, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, modify, and analyze generated content (anonymized where possible) for: (i) Service improvement, including AI training; (ii) compliance audits; and (iii) aggregated research.

Our Technology

We retain all rights to our AI models, software, and infrastructure. No ownership transfers to you. Generated content may incorporate third-party elements; you are responsible for ensuring legal use.

IP Infringement

If generated content infringes IP, you indemnify us per Section 11.

7. Privacy and Data Protection

Your use is governed by our Privacy Policy, incorporated herein. We act as a data processor under GDPR/CCPA for personal data in prompts, uploads, or videos; you are the controller. We comply with GDPR (e.g., data subject rights, DPIAs for high-risk AI), CCPA (e.g., opt-out rights), and other laws.

• Data Rights: EU/UK users can access, rectify, erase, or port data via privacy@aiveed.io. California residents have similar rights.

• AI Training Data: We use anonymized data for training; no personal data is used without consent.

• Cross-Border Transfers: We use EU Standard Contractual Clauses for transfers outside EEA.

• Content Moderation Data: We collect and process data related to content moderation, including: violation counts and timestamps, risk scores assigned by automated systems, content flagged as violating policies (text, images, metadata), NCMEC reports and law enforcement disclosures, and AWS Rekognition analysis results (moderation labels, confidence scores). This data is processed under our legitimate interests in platform safety, legal compliance, and child protection. You have NO right to deletion of CSAM-related data or law enforcement preservation requests. For other moderation data, EU users may request deletion after 12 months (unless under investigation).

8. DMCA and Copyright Policy

We respect IP rights and comply with the Digital Millennium Copyright Act (DMCA). To report infringement, send notices to dmca@aiveed.io with:

• Signature of IP owner or authorized agent

• Identification of copyrighted work claimed to be infringed

• Identification of infringing material and its location

• Contact information (address, phone, email)

• Statement of good-faith belief that use is unauthorized

• Statement of accuracy under penalty of perjury

We may terminate repeat infringers.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE OR BIASED; WE DISCLAIM LIABILITY FOR SUCH ISSUES. UNDER EU AI ACT, WE PROVIDE TRANSPARENCY ON HIGH-RISK USES UPON REQUEST.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (I) FEES PAID BY YOU IN THE PRIOR 12 MONTHS; OR (II) $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA LOSS.

11. Indemnification

You agree to indemnify, defend, and hold harmless AIVeed.io, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from: (i) your use of the Service; (ii) generated content; (iii) violations of these Terms or laws; or (iv) your negligence or willful misconduct.

CSAM and Illegal Content Indemnification

If you upload, generate, or share CSAM or other illegal content, you agree to indemnify, defend, and hold harmless AIVeed.io, its officers, employees, and agents from ALL claims, including but not limited to: (i) claims by depicted minors or their parents/guardians; (ii) criminal investigations or prosecutions related to your content; (iii) civil lawsuits arising from your violations; (iv) third-party claims of harm, defamation, or privacy invasion; and (v) regulatory fines or penalties imposed on us due to your conduct. This indemnity survives account termination and applies regardless of whether your content was blocked. You acknowledge that merely attempting to generate prohibited content triggers this indemnity.

12. Termination

We may suspend or terminate your account for violations, non-payment, or at our discretion with notice (where required). You may terminate anytime via account settings.

Upon termination: (i) access ceases; (ii) you may export data within 30 days; (iii) we may delete data after 90 days. Surviving provisions include ownership, indemnity, and limitations.

13. Dispute Resolution and Governing Law

These Terms are governed by California law, without conflict principles. Disputes shall be resolved by binding arbitration in San Francisco under JAMS rules (or AAA for claims under $10,000), with the prevailing party entitled to fees. No class actions. EU users may use ODR platforms. Jurisdiction for non-arbitrable matters: courts of San Francisco County, CA.

14. Force Majeure

We are not liable for delays due to events beyond our control (e.g., natural disasters, cyberattacks, regulatory changes).

15. Miscellaneous

• Severability: Invalid provisions do not affect others.

• Entire Agreement: These Terms supersede prior agreements.

• Export Controls: You comply with all export laws.
